Yasmin’s recent success in overturning a pre-tariff sift refusal for a life sentenced prisoner through a well-prepared letter before action is yet another example of her strategic and determined approach.
A pre-tariff sift refers to the process where the Secretary of State for Justice decides if the Parole Board will review a life sentenced prisoner's case approximately three years before their tariff (minimum term) expires, to decide if they are suitable for progression to open conditions.
A letter before action is a formal notice sent to an opposing party outlining the challenge to the decision and intentions to initiate legal proceedings if the issue is not resolved. In this case, after considering the letter before action, the Secretary of State for Justice reconsidered the decision, and accepted our client’s pre-tariff sift.
He will now have a Parole Board review to consider his suitability for open conditions.
